User: "User" refers to individuals who access or use the Service.

To use certain features of the Service, you must register for an account. You agree to provide accurate information and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Each account is for a single user only. You may not share your account credentials with others or allow others to access or use your account. We reserve the right to terminate accounts that are used by multiple individuals.

You are solely responsible for your Content and the consequences of sharing it through the Service. You represent and warrant that:

SurveyBrand offers various subscription plans with different features and limitations. When you subscribe to a paid plan, you agree to pay the subscription fees as described at the time of purchase.

Subscription fees are charged in advance and are non-refundable. Your subscription will automatically renew unless you cancel it before the renewal date. You can cancel your subscription at any time through your account settings.

We reserve the right to change subscription fees upon reasonable notice. Such changes will take effect on your next billing cycle. By continuing to use the Service after the fee change, you accept the new fees.

Our Service offers AI-powered tools to assist in generating survey questions, options, and content. While we strive to provide high-quality AI assistance, you acknowledge and agree to the following:

• AI Limitations: AI-generated content is created through automated processes and may not always be perfect, accurate, or appropriate for your specific needs. You are responsible for reviewing, editing, and approving all AI-generated content before using it in your surveys.
• No Guaranteed Outcomes: We do not guarantee that AI-generated content will produce specific results or outcomes for your surveys. The effectiveness of surveys depends on many factors beyond our control.
• Content Ownership: You own the final versions of surveys created using our AI tools, subject to our license to use such content as described in these Terms. However, the underlying AI technology, algorithms, and models remain our exclusive property.
• Usage Limits: We may impose reasonable limits on the use of AI features, including limits on the number of AI-generated surveys or questions, as specified in your subscription plan.
• Quality Control: While our AI systems are designed to create appropriate and effective survey content, you must exercise independent judgment and quality control. We are not responsible for any misleading, biased, or inappropriate questions that may be generated.
• Prohibited Content: You may not use our AI tools to generate surveys that violate our Acceptable Use policies, including but not limited to content that is discriminatory, harmful, misleading, or illegal.
• Training Data: By using our AI features, you acknowledge that anonymized patterns from your interactions may contribute to improving our AI systems. No personal information or specific survey content will be used for this purpose without explicit consent.
• AI Availability: We reserve the right to modify, limit, or discontinue any AI features at any time. We will make reasonable efforts to provide notice of significant changes to AI functionality.

Our Service allows you to collect, store, and process survey responses. With respect to this data:

• Response Storage: Survey responses are stored securely in our systems. Storage duration depends on your subscription plan and account settings. We recommend you export and back up important data regularly.
• Data Controller: For purposes of data protection laws, you are considered the data controller for survey responses you collect. You are responsible for ensuring you have appropriate legal bases and permissions to collect respondent data.
• Our Role: We act as a data processor for the survey responses you collect. We will only process this data according to your instructions and as necessary to provide the Service.
• Data Deletion: We may delete survey responses and related data after a reasonable period following account termination or as specified in our data retention policies.
• Usage Limits: Depending on your subscription plan, there may be limits on the number of responses you can collect or the amount of data you can store.

• Breach Notification: In the event of a data breach affecting your survey responses, we will notify you in accordance with applicable laws and provide reasonable assistance in your compliance with any notification obligations you may have to respondents or authorities.

Our Service provides tools to customize the appearance and styling of your surveys. Regarding these features:

• Templates and Designs: We offer various templates and design elements that you may use to style your surveys. These templates and elements are licensed, not sold, to you for use exclusively within the Service.
• Custom Branding: You may upload your own branding elements, such as logos and color schemes. You represent and warrant that you own or have properly licensed any custom branding elements you upload.

• No Warranty: While we strive for accuracy, we do not warrant that our analysis tools will be error-free or suitable for your specific purposes. You should independently verify any critical results or decisions based on our analysis tools.
